The United States Court of Appeals has scheduled an oral argument to hear the appeal of the one objector to the settlement. The argument will be at 9:00 a.m. on January 17, 2017 at the United States Courthouse, 601 Market Street, Philadelphia, PA. You are welcome to attend. Plans to distribute the settlement funds this summer have been delayed, indefinitely. On May 26th, the sole class member who objected to the settlement filed, through her attorneys, an Appeal of the Order of the District Court approving the settlement. It is impossible to know how long the appeal will delay distribution but, if the appeal is fully pursued, it would likely be over a year.

On May 10, 2016, the Court entered the Order and Final Judgment Approving Class-Action Settlement (the "Distribution Order") authorizing the distribution of the Settlement proceeds to eligible Class Members.

If you are a Class Member who has submitted a timely and complete Claim and Release Form to the Claims Administrator, you will be paid in the amount determined by the Claims Administrator to be awarded to you in accordance with the terms of the Settlement Agreement. The amount of your payment is set forth at the link below. You may appeal your award by filing a letter of appeal with the Court no later than June 15, 2016. Appeals may be made solely on the basis that the Claims Administrator has incorrectly calculated the amount of the award under the terms of the Settlement Agreement.
